Terms of Service

Last updated June 2026. These Terms govern your use of up2uagency.info and your purchase of any UP2U product or service. The clear, non-legalese version — email hi (at) up2uagency.info if anything is unclear.

1. Who we are

UP2U is operated by TABACU TUDOR-LUCREȚIU P.F.A., a Romanian sole-trader (Persoană Fizică Autorizată), sole registration code (CUI) 52423615, Trade Register no. F2025032098001, registered at 136 Bucureștii Noi Blvd., apt. 5, Sector 1, Bucharest 012366, Romania, European Union, represented by Tudor Tabacu. We trade under the brands "UP2U", "UP2U LIFE", and "UP2U Recruiting" ("UP2U", "we", "us", "our"). Contact: hi (at) up2uagency.info.

2. Acceptance of these Terms

By purchasing or using any UP2U product or service, you agree to be bound by these Terms, our Refund Policy, and our Privacy Policy, and you confirm you have the legal capacity to enter into this agreement. If you do not agree, do not purchase or use our products.

3. What we offer

Depending on what you buy, you receive either a digital product, a service, or a combination:

  • Tier 1 — "Not Native Still Hired" ($199): a self-paced digital course.
  • Tier 2 — Review ($349): the course plus personal review of your CV, intro video, and application materials.
  • Tier 3 — Full Mentorship ($750): a hands-on placement-assistance service (including the China Program variant where applicable). Payment is structured as $375 on signing + $375 once you have a signed school contract, or $600 paid upfront (a $150 early-payment discount).
  • Accent Advantage ($49), or Accent Advantage + Feedback ($89): a self-paced pronunciation course, optionally with personal feedback on your recordings.
  • The Guide to Teaching English in Vietnam ($19): a self-paced digital guide, with an optional Application Review add-on ($49).
  • TEFL certificate — DIY ($39) or We-Handle ($180): the DIY route gives you access to an accredited third-party course; the We-Handle route is a service under which, at your request, we manage the registration and processing of your certification with an accredited provider, issued in your name.

4. Intellectual property

All content in our digital products — video lessons, audio recordings, written materials, templates, graphics, and case-study recordings — is the intellectual property of TABACU TUDOR-LUCREȚIU P.F.A. You receive a personal, non-exclusive, non-transferable licence to use the materials for your own career development. Sharing, reselling, redistributing, screen-recording for redistribution, or reproducing the content for commercial purposes is prohibited and will result in revocation of access without refund. Case-study recordings of past UP2U teachers are shared with their written permission; sharing them outside the product violates both these Terms and those teachers' privacy rights.

5. Tier 3 — placement-assistance service

Tier 3 is a hands-on assistance service, not a digital product and not a guarantee of employment. When you are accepted, our team begins work — reviewing your case, coaching your video and materials, coordinating with schools, and assisting with your document package and the registration of your employment relationship.

Our commitment: we make all reasonable efforts to assist you in securing employment and continue working with you, at no additional charge, until you sign an employment contract — and, if you are not placed within two months of your target hiring cycle, we keep working with you at no extra cost until placement is achieved, for as long as you keep meeting your obligations.

What we do not guarantee: the hiring decision, the salary, the city, and the school rest solely with the employer. We do not guarantee a specific employer, salary, location, or that employment will ultimately occur.

You agree to: provide true and complete information and documents; not engage another placement agency for the same purpose during the engagement; obtain your employment visa at your own expense once invited; comply with the laws of the country of employment; and ensure your health status is compatible with the role. We are not responsible for loss of work, contract termination, or consequences arising from your incompatibility with the employer's rules, the applicable law, your health, your documentation, or matters outside the scope of this service.

6. TEFL certification

A legalised 120-hour TEFL/TESOL certificate is required by Vietnamese law for the work permit. You may self-study with an accredited third-party provider we recommend, or use our We-Handle service under which we manage the registration and processing of your certification with an accredited provider (currently Global Language Training, United Kingdom), issued in your name. The TEFL options are non-refundable (see the Refund Policy).

7. Payment and refunds

Payments are processed by Stripe and other payment routes we make available. Each product has its own refund terms — Accent Advantage and Tier 1 / Tier 2 carry a 7-day money-back guarantee, Tier 3 uses a continuation structure rather than a money-back refund, and the TEFL options are non-refundable. 8. No guarantee of outcomes

We draw on 700+ placements since 2017 across 32+ countries, but we cannot guarantee employment, a specific salary, a specific school or city, or a specific level of pronunciation improvement. Outcomes depend on your qualifications, your market, your interview performance, the consistency of your practice, and your effort.

9. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or in connection with any product or service is limited to the amount you paid for that product or service. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — including liability for fraud, gross negligence, death or personal injury caused by our negligence, or your mandatory statutory rights as a consumer.

10. Your rights as a consumer (EU/EEA/UK)

If you are a consumer in the EU/EEA or the UK, you may have a statutory right of withdrawal for a limited period after purchase. For digital content that begins immediately and for services you ask us to begin right away, that right may be limited or lost once performance starts, to the extent permitted by law. Nothing in these Terms removes any mandatory consumer protection you have under the law of your country of residence.

11. Governing law and disputes

These Terms are governed by the law of Romania. We will always try to resolve any dispute amicably first — email hi (at) up2uagency.info. Failing that, the courts of Bucharest, Romania, have jurisdiction; however, if you are a consumer in the EU/EEA or the UK, you keep the mandatory protections and the right to bring proceedings in the courts of your country of residence that the law gives you.
